Ex-WWE star Ted DiBiase Jr filed a motion yesterday to the court seeking a mistrial in his current criminal trial. The star was arrested and charged with fraudulently getting millions of dollars in federal funds.
As per a report by PWInsider, in the latest twist in the huge drama of the criminal trial that could see the former WWE star in jail for multiple years, the star has applied for a mistrial due to issues with his lawyer.
The motion saw him reveal that his primary attorney, Jason Scott Gilbert that will is dealiong with a medical not allow him to finish the trial proceedings. DiBiase also said that the co-counsel had not yet reviewed the entire material relating to the case and so would not be able to proceed. He said that he had the right of choice council and thus the current trial should be declared a mistrial.
“Early in the trial, Mr. Gilbert—the principal architect of the defense who has been Mr. DiBiase’s lead counsel from the outset of the case—was unexpectedly stricken with a serious medical emergency in the middle of his questioning of the government’s star witnesses, John Davis. Mr. Gilbert’s cross-examination of Davis was going so successfully that the government asked the Court for permission to treat Davis as a hostile witness on redirect.”
This would delay proceedings considerably if it was accepted. The details as to what exactly the attorney is suffering from is not certain at this time.
The court is asking the government to respond to the motion by January 26. Further details of the case will be known by then. n
